Dr. Mustafa A. at the Bağcılar 42 Evler Family Health Center sexually assaulted one of his patients.
After the women filed a complaint against him, Bakırköy Public Prosecutor's Office written an indictment against the doctor for "sexual assault by misusing the power that comes from public service" upon the Turkish Penal Code Article 102/3-b. Bakırköy 35th Penal Court of First Instance accepted the indictment.
The doctor was suspended for only two months
According to the minutes, Dr. A. was also complained against at the Ministry of Health and was investigated by Küçükçekmece District Health Directorate. Nurses and doctors were also testified. As a result of the investigation, the doctor was suspended from duty for two months in 2018. He resumed his duty after being given 20 penalty points.
Being notified of the patient's complaint about sexual assault on April 4, 2018, the doctor said in his defense statement that the patient had a "psychological disorder" and he was slandered.
Minutes do not confirm the doctor
A minute written by accoucheuses and nurses who work in the same place with Dr. A. confirms the charge of sexual assault.
According to the minute written in February 2018, three colleagues of the doctor said that since July 2017, there had been complaints that A. often harassed his women patients physically, on the phone and social media.
Other patients also complained about him
A statement by a nurse in the investigation said that the doctor harassed other patients as well.
"I don't remember the name. One of my patients called and said that doctor A. harassed her and she had a nervous breakdown. The patient said, 'Doctor A. harassed me and my neighbors.' The patient said doctor A. also harassed her on social media, sending her various messages."
A patient asked, 'Is this doctor a pervert?'
Here is another nurse's statement:
"A patient said she went through a physical examination, although she only requested a blood test. The same patient said doctor A. found and disturbed her on social media."
Another nurse said, "A patient stated that she is very disturbed because of his behavior. She asked me, 'Is this doctor s pervert?' I told what I heard to the nurse who works with doctor A. She corroborated what I told her."
Court sentenced him to prison
Bakırköy 35th Penal Court of First Instance announced its verdict in the final hearing on November 7.
The court, considering the personal and social condition of defendant Mustafa A., sentenced him to 5 years in prison.
It increased the sentence by ½ to 7 years and 6 months, then reduced the sentence by ⅙ to 6 years and 3 months.
