Lawyer of Mızraklı: ‘Allegations are Fictional, We will Appeal Against His Arrest’

Zülal Erdoğan, the lawyer of dismissed and recently arrested Metropolitan Co-Mayor of Diyarbakır Adnan Selçuk Mızraklı, has spoken to bianet.

Mızraklı was arrested by the Diyarbakır 3rd Penal Court of Peace on October 22. The accounts of "Bermal" code-named H.B.A, who turned himself in three years ago in Mardin, were cited as the reason for his arrest.

Mızraklı: I don't accept the allegations

As reported by the state-run Anadolu Agency (AA), in ruling for the arrest of Mızraklı, the penal court of peace referred to the allegations that "Mızraklı treated and discharged a wounded terrorist; for six years, he was the chair of Sarmaşık Association considered to sponsor the terrorist organization PKK/KCK; upon the call of the organization, he attended events where the actions and activities of the organization were praised."

In his defense in response to these allegations, Mızraklı said, "I do not accept such allegations. I did not keep vigil at the hospital because I was a senior physician. The witness mentioned that the intestines of the patient were cut off and removed. According to medical rules, it is against the natural flow of life that a person who undergoes such an operation is discharged and leaves the hospital on the following day."

Speaking to bianet about the arrest of his client, Zülal Erdoğan, one of the lawyers of Selçuk Mızraklı has indicated that the allegations are abstract. Announcing that they will appeal against the verdict of arrest, lawyer Erdoğan has stated the following in brief:

'There is a confidentiality order on the file'

"We cannot fully examine the case file of Selçuk Mızraklı as there is a confidentiality order on the file. Our authorities have been restricted. Therefore, we know the charges brought against Mızraklı entirely based on the questions asked to him at court.

"We can say that each and every stage from his detention to his arrest is against the law. Because there is no concrete evidence for his arrest.

"In news spread yesterday, it was alleged that the testimony of the anonymous witness was the reason for his arrest.

"But, according to the file, it is an open source information. There is a confessor and Mızraklı has been arrested depending on the statements of this confessor. The identity information of this person is written in the file. For this reason, he is not an anonymous witness.

'He wanted to benefit from the repentance law'

"The person who witnessed at the file turned himself in 2016 and wanted to benefit from the effective repentance law. He did not make any statements about Mızraklı for three years and, just before the March 31 local elections, on March 20, he made a statement and maligned Mızraklı.

"The testimony of this person does not reflect the reality, his statements do not bear any relation to the truth.

'Mızraklı does not keep vigil at hospital'

"Since Mızraklı is a surgeon, he does not keep a vigil of any kind at hospital. Thus that he kept vigil and treated a person does not reflect the reality.

"We think that the statements of this person who stood trial before are not lawful. It is quite apparent that they are fictional. All of his statements are hearsay and slander." (HA/SD)
