First indictment rejected due to missing points

Musa O. was detained as part of the investigation on July 16. He was referred to court with a request for his arrest; however, he was then released on probation. The Chief Public Prosecutor's Office objected to this ruling, but it was not accepted. An indictment was prepared on July 27.

The indictment was returned to the prosecutor's office on the grounds that it had missing points. The prosecutor's office objected to this decision. With this objection accepted, the prosecutor's office once again demanded the arrest of Musa O. with this indictment. He is now arrested.

The eight-page indictment against him refers to the statements of İpek E. and demands that Musa O. stand trial for "aggravated sexual assault."

'I am traumatized, I am on the verge of suicide'

The indictment refers to the statements of İpek E. briefly as follows:

"I met this person named Musa O. on social media. We became lovers after talking for some time. When I spoke with him, he was constantly saying that he would marry me, make me happy, make me live in good places and ask for my hand in marriage. He was also asking me over and over again whether I would run away with him. He was telling me to come with him..."

Forensic medical report proves sexual assault

İpek E. also said that he was sexually assaulted by Musa O:

"I want to file a lawsuit and a criminal complaint against this person who is on duty at the Siirt Provincial Gendarmerie Command and whose name I know as Musa O. I am traumatized. I want the person to be punished in the severest way possible. I am crying day and night. I am on the verge of suicide. I cannot look at my family in the face."

As for Musa O, he dismissed the charges. While the the Forensic Medicine Institution report documenting the sexual assault of Musa O. has also been added to the indictment, the related video footage is also reportedly in examination. In the conclusion part of the indictment, it has been indicated that Musa O. will remain behind bars pending trial.

What happened?

Living in the Beşiri district of Turkey's southeastern province of Batman, İpek E. appealed to the Siirt Chief Public Prosecutor's Office on July 7 and filed a criminal complaint against specialist sergeant Musa O. Indicating that he raped her, E. gave a detailed deposition to the prosecutor.

On July 16, she left a letter and attempted to claim her life with a gun. She was taken to the Batman Regional Hospital. İpek E. was seriously wounded when she was hospitalized. After being treated there for 34 days, İpek E. lost her life at the hospital on August 18, 2020.

The indictment was returned due to missing points. The prosecutor's office objected to this decision as well. With this objection accepted, the office demanded Musa O.'s arrest again with this indictment. Amid social media outrage, Musa O. has been arrested and sent to prison.

Article 16 – Preventive intervention and treatment programmes

1) Parties shall take the necessary legislative or other measures to set up or support programmes aimed at teaching perpetrators of domestic violence to adopt non-violent behaviour in interpersonal relationships with a view to preventing further violence and changing violent behavioural patterns.

2) Parties shall take the necessary legislative or other measures to set up or support treatment programmes aimed at preventing perpetrators, in particular sex offenders, from re-offending.

3) In taking the measures referred to in paragraphs 1 and 2, Parties shall ensure that the safety of, support for and the human rights of victims are of primary concern and that, where appropriate, these programmes are set up and implemented in close coordination with specialist support services for victims.
