The indictment of the newly opened investigation related to the pending Revolutionary Headquarters Trial turned out to include a report of the National Intelligence Agency (MİT).
The report was sent to the Istanbul Public Chief Prosecution by the Istanbul Governorship Police Directorate on 17 March 2012. The "Istanbul MİT Regional Presidency" was given as the subject matter.
The report was signed by 3rd Class Chief of Police Yurt Atayun of the Anti-Terror Branch Directorate but it has not been reported by which MİT member it was signed.
It was claimed that the report was sent with the idea to constitute the base of the operation "Etude" that comprised information about the origin, establishing and activities of the illegal Revolutionary Headquarters Organization.
The report includes names of lawyers, writers and legal organizations such as the People's Democratic Congress (HDK), the Party Initiative for Social Freedom, the Roof Party Initiative, the RED Magazine, the Socialist Democracy Party and the 'Who is next' Initiative.
"Two operations were carried out after the report"
Lawyer Gülizar Tuncer whose name is also mentioned in the report said in a meeting of the 'Who is next' Initiative in Istanbul that after the report was sent, two operations had been carried out by reason of alleged membership in the Revolutionary Headquarters Organization. He announced that the people who were mentioned in the report were arrested.
"By influencing the judiciary the MİT is committing a crime with this report that is based on defamations that lack any evidence. Are the other people whose names are included in the report going to be arrested one by one?"
Lawyer Ercan Kanar, also mentioned in the report, claimed that the police was directing all indictments. However, for the first time, an MİT report was openly included in an indictment, he pointed out.
"The report influences the judiciary"
Kanar emphasized that the report disregarded privacy and lacked evidence. According to the lawyer, including such a report that influenced the judiciary into an indictment was contrary to the law.
"The report tries to show all opposition sections in society as potentially guilty. The other lawyers and I are accused of working as couriers for the organization because we met our clients in prison".
Kanar announced to file a criminal complaint against the members of the Supreme Council of Judges and Prosecutors (HSYK) and of the 9th High Criminal Court who were involved in accepting the report in the indictment.
"The visit to my boy-friend was deemed a courier job"
One of the people mentioned in the report is HDK member Gülfer Akkaya. She said that her visit to her boy-friend Tuncay Yılmaz who is detained due to alleged membership of the organization was deemed a courier job for the organization.
"Neither Tuncay nor I am a member of the organization. Should I not visit my boy-friend with whom I have been together for 16 years? I am being exposed to state violence".
Also Peace and Democracy Party (BDP) Central Steering Board Member Şamil Altan's name is mentioned in the report. In his opinion, the report aimed at cutting the link between Turkish socialists and the struggle for a solution of the Kurdish question.
"Socialists are being criminalized"
Halit Erçi, spokesman of the Party Initiative for Social Freedom, claimed that all socialists were tried to being criminalized and to be obstructed from doing politics on legal and legitimate grounds.
Bülent Parmaksız, writer of 'Reality in Turkey' and member of the HDK, emphasized that the HDK was the strongest link between the Kurdish and the Turkish people and that the government was disturbed by that.
