Constitutional Court Finds “Right Violation” in Sledgehammer Case

Responding to the complaint of 230 defendants in Sledgehammer case, Turkey’s Constitutional Court found that their rights were violated regarding digital data and hearing of witnesses. 

According to that, defendants will be put on trial again in order to restore their rights. 

The ruling was issued with a majority vote of 17 penal judges. 

Ülgen: Some defendants might be released 

According to Hürriyet newspaper, Celal Ülgen, a defense attorney in the case, said the following: 

“We are expecting [defendants’] freedoms to be restored. According to our laws, you can appeal to the main court through a local court by referring to the constitutional court ruling. We have obviously observed certain practices that violated the right to fair trial.  

“We need to make something clear. Yes, there might a re-trial process, however, if the ruling was taken based on Constitutional Court’s regulations and rights that were given within laws, some defendants might be released as it will affect the execution. And others will also appeal in other cases. (EKN/BM)
