Council of State Blocks Government Regulation on Investigations
The Council of State 10th Chamber blocked the government regulation to force police and prosecutors to disclose investigations to their superiors with majority vote.
The case reviewed by chairman
On the contrary to routine procedures, The Council of State 10th Chamber Chairman Mehmet Rıza Ünlüçay reviewed the case himself instead of handing it over to a subordinate judge.
The council assembled as of this afternoon and suspended the aforementioned regulation without demanding a defense statement from the government, saying that it could cause “unrepairable damages”.
The case was brought to the attention of Council of State by Turkey’s Bar Union Association, Judge Union, Liberal Democratic Party and Ankara Bar Association.
According to the regulation that has not been implemented, police chief would immediately alert governors regarding judicial events.
The same way, prosecutors would be required to disclose their findings to their superiors during the investigation process. (AS/BM)
