Constitutional Court Ruling on Deportation: She Can Live With Her Daughter in Azerbaijan

The Constitutional Court has deemed the deportation of Azerbaijan citizen Peri Kırık, legal. Kınık has been living in Turkey with her daughter, who is subjected to violence by her husband.
Kırık requested the overturn of the deportation verdict, stating that her daughter is in the divorce process and it is staying with her daughter against the risk of the husband's violence.
Kırık reported the husband's violence
Peri Kırık filed a complaint against her daughter's husband at the Esentepe Police Center in İstanbul on April 29, 2015. The police here determined that Kırık was living illegally in Turkey and took her testimony. Kırık said she lost her passport in 2012 and did not apply for a replacement.
The court ruled for her deportation on the following day.
"I have been living in Turkey for years"
Kırık applied against the verdict at the İstanbul 1st Administrative Court.
In her lawsuit petition, Kırık said that she was married to a citizen of Turkey in 2006 and has been living in the country for years. She also said that her daughter is in the divorce process and it is staying with his daughter against the risk of the husband's violence.
The court rejected her appeal.
Application to the Constitutional Court
Kırık applied to the Constitutional Court on December 21, 2015.
Kırık stated that she has been living in Turkey for years and did not commit an offense. Her daughter is also here and needs her support in the divorce process.
She claimed that her right to respect for family life is violated by the deportation verdict.
The reason is "preserving the public order"
The Constitutional Court rejected Kırık's appeal. The justified ruling was published on the Official Gazette today (January 31).
In the ruling, the court stated that the "legitimate" aim of the deportation verdict is "to preserve the public order" and that the applicant can live with her daughter in Azerbaijan. (AS/VK)
