Woman Whose Leg was Amputated to be Paid 300 Thousand Euro in Damages

The European Court of Human Rights (ECtHR) has ruled that Ayşe Timurlenk, whose leg was amputated due to the complications that ensued a surgical operation, shall be paid 300,000 Euro in non-pecuniary damages.

Timurlenk was treated for a tumor at the Gülhane Military Medical Academy (GATA) Gynecology and Obstetrics Service. Her leg was amputated in August 1996 as a result of the surgical operations that she underwent.

He filed a lawsuit at the Ankara 3rd Administrative Court on charge of "medical negligence." The judicial process was concluded in 2008. The court ruled that Timurlenk should be paid 50 thousand Turkish Lira (TRY) in pecuniary and non-pecuniary damages.

Including the interest that accrued from the year 1996 to 2008, the Ministry of National Defense paid 330 thousand TRY in total to Ayşe Timurlenk. However, with a change in the dates of verdicts, she had to pay 28 thousand TRY of this money back to the ministry.

Timurlenk appealed to the ECtHR. Announcing its ruling on Timurlenk, the ECtHR has ruled that she shall be paid 300 thousand Euro in non-pecuniary and 1,250 Euro in pecuniary damages. (AS/SD)
