Attorney of Selçuk Mızraklı: Lie of the Witness Revealed

It has been understood that the accounts of confessor H.B.A., who alleged that she worked at the same hospital with dismissed and recently arrested Metropolitan Mayor of Diyarbakır Dr. Adnan Selçuk Mızraklı for some time in the past, do not reflect the truth.
Lawyer Zülal Erdoğan, the lawyer of Mızraklı, has indicated that the insurance records of the H.B.A do not confirm that she worked at the hospital within the indicated time period.

H.B.A. alleged that a "Hogır" code named Kurdistan Workers Party (PKK) member was taken to a private hospital in Diyarbakır after being wounded, he was operated by Mızraklı and discharged from the hospital without being turned over to the security forces. However, according to the Social Security Institution (SGK) records, H.B.A. was not working at the hospital at the time when Mızraklı allgedly did the surgery.
The indictment filed against Mızraklı was accepted by the Diyarbakır 11th Heavy Penal Court on November 5. The court requested that the file of another ongoing lawsuit against him at the 9th Heavy Penal Court be combined with this case as there is a factual link between the two.
Discussing the request, the Diyarbakır 9th Heavy Penal Court has ruled that two case files shall be combined. The court has also rejected the lawyers' request for Selçuk Mızraklı's release.
After the court has decided to combine the files, the restriction order previously issued for the recent case has been lifted. The insurance records of both Mızraklı and witness H.B.A. have been requested from the SGK to see on what exact dates they worked at the hospital.

The registers have shown that H.B.A. was not working at the hospital at the time when Mızraklı allegedly operated on a wounded PKK member.
In her accounts cited in the bill of indictment, witness H.B.A. said, "I knew Adnan Selçuk Mızraklı while I was working as an anaesthetist at a private hospital at Diyarbakır Dağkapı square.
"... One day, - as far as I can remember, it was in late 2012 or early 2013 -, when I started working in the morning, I saw that there was a patient in intensive care unit. This person underwent a surgery after being brought from the rural side of Diyarbakır province late at night as he was having an intestinal knot. Later on, I learnt that the surgery was done by Mızraklı."
The insurance records taken from the SGK and added to the case file have shown that H.B.A. started working at the hospital on September 15, 2011 and she stopped working there on March 2, 2012.
Erdoğan: Mızraklı does not know the witness
Speaking to bianet, his lawyer Zülal Erdoğan has stated the following:
"The information that we have obtained after the restriction order has been lifted is an indication for how fictional the accounts of the witness named H.B.A. are. We submitted a petition of objection to the court again on November 12 and we also cited these allegations that do not reflect the truth.
"Also, when we met Dear Selçuk Mızraklı in prison last week, he told us that he did not know the person named H.B.A. He said over and over again that she might have worked at the hospital, but her name did not ring a bell."
Mızraklı will have his first hearing on December 25.
What happened?
Adnan Selçuk Mızraklı was taken into custody on October 21 as part of an investigation conducted by the Diyarbakır Chief Public Prosecutor's Office. He was arrested on day later on charges of "propagandizing for a terrorist organization" and "membership of a terrorist organization."
The indictment issued by the Diyarbakır Chief Public Prosecutor's Office was accepted by the Diyarbakır 11th Heavy Penal Court on November 11. Mızraklı has been facing 7.5 to 15 years in prison on the offenses charged. (RT/SD)
