Appeal against Detention of Journalist Balbay Dismissed
The appeal against the decision to reject the release of journalist Balbay was dismissed. Balbay was elected Member of Parliament in the general elections on 12 June. He is a detained defendant of the second Ergenekon trial.

Journalists Yalçın, Pehlivan and Terkoğlu from the Oda TV news site applied to court for their release pending trial. They were arrested last week. Journalist Balbay, detained in the scope of the Ergenekon trial for 31 months, applied to the ECHR.

Ergenekon Defendants Criticize Court for "Advanced Punishment"
Mustafa Özbek, defendant of the Second Ergenekon Case, was removed from the courtroom in the 78th hearing after he said, "What right do you have to keep me here? Fear Allah!" Journalist Balbay criticized, "This is advanced punishment, you are dispensing the law in instalments".

Seventh Trial against Journalist Saymaz

Harsh Criticism Part of Freedom of Expression
The Judicial Office decreed to account journalist Mustafa Balbay's pronouncement as part of freedom of expression, regarding his reference to Prof. Baskın Oran as an example of "bought-out intellectuals". The comment was assessed as "harsh criticism".

Cumhuriyet newspaper journalist Ankara correnspondent Mustafa Balbay said in his defence in the Ergenekon Case, "I did not even incite an unarmed uprising. I took the notes put forward as my diary in order to recall a couple of things later on".

Cumhuriyet Newspaper Wiretapped in Ergenekon Investgation!
Cumhuriyet newspaper claimed two journalist were illegally wiretapped related to an operation concerning journalist Mustafa Balbay, who is a detained defendant under charge of "membership of the Ergenekon terror organization". TGC chairman Erinç said that this is a deprivation of the right of freedom of speech for everybody living in Turkey.

Journalist Bila claimed in the Milliyet newspaper today that former Chiefs of Staff Özkök and Büyükanit are willing to go to court in relation to allegations of coup plans which have become public in a diary alleged to belong to journalist Balbay.

“Cumhuriyet”s Ankara Rep. Balbay Is Out
The court released “Cumhuriyet”s Ankara representative Balbay. He declined to comment about the incident, saying that the judiciary process was still not completed. Authorities are still questioning retired generals Tolon and Eruygur.
