ECtHR Rules in Favor of Conscientious Objector Aydemir
ECtHR passing a sentence on the trial of conscientious objector Aydemir refusing to do military service due to his religious belief, has ruled that Turkey had violated Article 3 of the convention prohibiting torture, and "inhuman or degrading treatment or punishment" and convicted Turkey to 18,000 compensation payment.

The fourth hearing of the "Everybody is born as a baby" trial against Savda, Aydemir and Atak, supporters of conscientious objector Aydemir, was held on 14 December. The defendants' request to consult a gynaecologist on the topic was dismissed.

Gynaecologist Requested as Expert in Conscientious Objection Trial
The five defendants tried for having supported conscientious objector Enver Aydemir appeared before the court at their third hearing in Eskişehir on 6 October. Lawyer Doğanoğlu reiterated his request to call a gynaecologist for an expert opinion.

Torture Suspect Officers Not Attended the Enver Aydemir Trial
Colonel M.Ö. and petty officer İ.S., who are on trial with charges of torturing Enver Aydemir, a conscientious objector that was taken into custody on December 24, 2009 and arrested, did not come to the hearing. Aydemir’s lawyers challenged the court arguing that it lacks fair trial standards.

Ankara Prosecutor Karakuş demanded the acquittal of 19 defendants who were tried for supporting conscientious objector Aydemir. Yet, one defendant received a prison sentence of 1.5 years, three defendants were each sentenced to six months in jail.

Conscientious objector Aydemir was relaeased upon an "incapability report". His lawyer criticized that the legislation lacks provisions on conscientious objection. Turkey is one of three countries of the European Council that does not recognize the right to conscientious objection.

Enver Aydemir, conscientious objector for religious reasons, has been treated as a "deserter" for about three years now. His lawyers stated a lack of authority of the military court. The court declined their request and sentenced Aydemir to ten months imprisonment.

Disciplinary Fine for Detained Conscientious Objector Aydemir
The Eskişehir Military Court imposed a one-month disciplinary fine on conscientious objector Enver Aydemir because of his refusal to wear prison clothes and disobedience of orders. Aydemir is not allowed for one month to see anybody else but his lawyer.
