The Constitutional Court (AYM) acknowledged specialist sergeant Y.K who was issued room confinement to be right and ordered Turkish Armed Forces (TSK) to pay 823 Euros for material compensation.
AYM ruled that Y.K.’s complaint about the violation of his right of freedom and security was acceptable.
Room confinement six times
According to the news of Hürriyet daily, Y.K. who was a gendarmerie specialist sergeant had room confinement and administrative restriction six times from September 20, 2012, to January 29, 2013.
After the first room confinement, Y.K. appealed to European Court of Human Rights (ECtHR) and then he appealed to AYM for other room confinements.
AYM General Assembly rescinded Article 169 of Military Penal Code related to regulation “Each superior and commandant may temporarily detain the soldier who breaks discipline” two years ago.
ECtHR had convicted Turkey on rights abuse in military before
ECtHR had sentenced Turkey to pay a fine in the amount of 17,500 euros on the charge of violating the rights of freedom and security in the case of four specialist sergeants who had room confinement. (EKN/BD)
