The Adana Chief Public Prosecutor's Office has pronounced its decision on Public Prosecutor Mehmet Bülbül, who had physician Kemal Gökhan Günel detained after he refused to examine him at the Osmaniye Public Hospital on the grounds that he did not have an appointment.
The chief public prosecutor's office in Adana has concluded that "as a result of lack of evidence and elements of the offenses charged, there is no ground for prosecuting him on behalf of the public." Prosecutor Bülbül was facing possible charges of "actual bodily harm and threat."

A day after the Adana Chief Public Prosecutor's Office gave this decision, a lawsuit has been filed against physician Kemal Gökhan Günel on charge of "publicly insulting a public official due to his or her duty."
As the indictment has been accepted, Günel will now appear before the judge at the Osmaniye 7th Penal Court of First Instance.
The indictment has indicated that prosecutor Mehmet Bülbül went to the hospital for treatment, but even though the physician was on duty, he avoided the treatment. The indictment has also noted that though the complainant said that he was a public official, the defendant gave a 'white code' and called the police and security guards of the hospital.
According to the indictment, physician Günel addressed the security guards before the hospital police and witnesses and told them, "Get him out of here. No matter who you are... You may complain to whomever you want... He will supposedly have me expelled. You, boor." The indictment has argued that Günel "displayed humiliating and dishonorable behavior."
Noting that the incident was captured by the hospital cameras as well, the indictment has demanded thatKemal Gökhan Günel be penalized on charge of "publicly insulting a public official due to his or her duty" and that the physician be deprived of some of his rights.
What happened?
Osmaniye Public Prosecutor Mehmet Bülbül went to the orthopedics department of the Osmaniye Public Hospital on April 12, 2021. According to the allegations, he wanted to be examined by orthopedist Kemal Gökhan Günel without having an appointment.
A ruw ensued as Günel refused to do it.
After this row, physician Günel was summoned to depose. Giving his statement together with his colleagues, Günel was released. After the incident was reported in the press, Osmaniye Chief Public Prosecutor Ahmet Tekne released a written statement and announced that physician Günel was summoned to depose upon prosecutor Bülbül's complaint.
