The Union of Turkish Medical Doctors (TTB) has announced the results of its inspection of the Medical Examiner’s report that led to the release of Hüseyin Üzmez, on trial for sexually abusing a child.
The TTB said that because of the urgency of the matter, they made use of the information that appeared in the media.
Evaluating the report procedurally, the TTB concluded the report could not be accepted as an expert report legally and advised the court reconsider its decision of release.
“Justice of Ministry and the Medical Examiner’s Office should reveal its accelerated report”
According to the TTB:
- That the report concluded there were no signs of physiological and psychological trauma without including the finds about the examination makes the report deficient scientifically and therefore not permissible.
- The Office examined B.Ç. on Friday September 1, 2008 and submitted it on Monday September 22, 2008. Preparing a proper report usually takes more in order to prepare it free of errors and this usually takes 3 to 4 weeks for the Medical Examiner’s Office. One working day for preparing the report shows that the process was speeded up and this raises doubts about the result. The Ministry of Justice and the Medical Examiner’s Office should explain how this process was conducted.
- According to the law, there had to be a child’s psychiatrist in the examination. A report prepared in this way cannot be accepted legally as an expert report.
- That the head of the examination was an expert in mental health and diseases does not prove that the report prepared for B.Ç. was scientific, because the branches of mental health and diseases and child’s psychiatry are two separate fields of medicine and they cannot replace each other. (EZÖ/TB)
