Ayşe Yılbaş murder case finalized with aggravated life sentence. Defendant H.G.Ö. couldn't benefit from abatement.
H.G.Ö. had already punished with aggravated life sentence on 2009 however after the reverse judgement of the Supreme Court, the lawsuit process restarted in February 2012.
Lawyer Meriç Eyüboğlu evaluated the trial and the decision:
"Now the defendant is charged with "intentional killing" and punished with aggravated life sentence. In 2009, the sentence was two times more as he was charged with "premeditated murder" and killed his wife before the end of the divorce process.
"The Supreme Court reversed the judgment on the grounds that there was not enough evidence of 'premeditated murder' ".
"At this second trial process that finalized today, the court decreed there's no 'premeditated murder' however he was punished with aggravated life sentence due to "intentional killing" and "commit a crime against a spouse"
" The common feature of both decisions is there's no unjust provocation abatement"
"When the trial process started again, the defendant and the attorneys have made incredible claims that have never been on the agenda of the court before, in order to be able to benefit from unjust provocation abatement. However the court did not abate. It's a progress as the indicted husband is sentenced to aggravated life sentence and there's no abatement. However, it's a 'premeditated murder' and we do not agree with the court in this respect.
" Ayşe is no more with us. It's not so important to sentence men after they murdered women. We don't want murdered women; we don't want to die. We cannot say, "justice has been served". We are in pain."
What had happened?
Ayşe Yılbaş was an intern at Neurology service of Cerrahpaşa Medical School. Her husband Petty Officer master sergeant Özmen was threatening to kill her "on a Friday at the time of the call to prayer" as she was trying to divorce him. On 22 February 2008, Yılbaş was shot twelve times by her husband at the Neurology service of Cerrahpaşa Medical School.
The court case began on 7 May last year and finalized on 28 July 2009. Hüseyin Güneş Özmen, has been handed a life sentence under severe conditions. However, the Supreme Court reversed the judgment on the grounds that there was not enough evidence of 'premeditated murder', the lawsuit process restarted on 21 February 2012. (ÇT)
