The decision of non-prosecution given by the Ankara Chief Public Prosecutor's Office for the suspicious death of domestic worker Nadira Kadirova has been taken to the Constitutional Court.
23-year-old Kadirova from Uzbekistan was found dead on September 23, 2019 in the house of Şirin Ünal, an MP from the ruling Justice and Development Party (AKP). She was claimed to shot herself dead with Ünal's weapon. The prosecutor's office also concluded that there was a lack of grounds for legal action and closed her investigation file on March 5.
In his appeal to the Constitutional Court, attorney Prof. İlyas Doğan has raised concerns over the fact that the crime scene investigation was not properly carried out and that the basic principles of an effective investigation were not followed in Kadirova's case.

Speaking to bianet, attorney İlyas Doğan previously said that "the failure to make a crime scene investigation was a violation of right to life" and added that they would apply to the Constitutional Court.
'Her death not effectively investigated'
As reported by Ali Isıyel from Halk TV, attorney Doğan has submitted a petition to the Constitutional Court, indicating that the basic principles of an effective investigation were not observed in Kadirova's investigation and the crime scene investigation was not done meticulously.
While the report taken down at the scene on incident indicated that there were 150 centimeters between her and the weapon, the sketch prepared on the computer showed this distance as 57 centimeters.
The petition to the Court has underlined that a person who committed suicide could not possibly throw a 4.5-kilogram weapon to such distance.
The weapons specialists that İlyas Doğan consulted about the incident stress that this distance can be between 25 and 40 centimeters at most.
The report taken down at the scene of incident alleges that Kadirova had her back against the heater in the room. The distance between the weapon and the heater is also striking.
Attorney Doğan finds it controversial that the 1.5-meter distance in the picture is shown as 57 centimeters in the sketch drawn on the computer.
The picture taken at the scene of incident also shows an overturned lampshade, which suggests a possible struggle, says Doğan.
Points missed out in the report
According to attorney İlyas Doğan, the following points have been missed out in the report prepared by at the scene of incident:
* The firing angle is not cited in the report.
* Though there are more than one messages on Kadirova's phone, it is not shown in the video recorded at the scene of incident.
* The blood pool is under the overturned coffee table.
* The bloodstain on the window frame cannot be explained.
* The calibre of the weapon was not written down.
* Fingerprints were not taken.
The report prepared at the scene of incident says that the hole of bullet on the wall is 80 centimeters above the floor. However, the video captured at the scene shows this height as 120 centimeters.
Accordingly, the petition submitted to the Court has noted that the failure to take the above points into consideration suggests that the basic principles of an effective investigation were not abided by in her case.
What happened?
23-year-old Nadira Kadirova from Uzbekistan was a domestic worker caring for the ill wife of Şirin Ünal, an İstanbul MP for the ruling Justice and Development Party (AKP).
Kadirova was found dead in Ünal's house on September 23, 2019.
It was alleged that she committed suicide with Ünal's weapon. The post-mortem procedures of Kadirova were followed by Ünal's chauffeur and the procedures that usually take longer were completed in a few days. After this swift post-mortem examination, the deceased body of Kadirova was sent to her home country and laid to rest there.
The death of Kadirova was found suspicious. While women kept asking "What happened to Nadira?" on social media, the MPs of the main opposition Republican People's Party (CHP), Peoples' Democratic Party (HDP) and Felicity Party (SP) brought the issue to the Parliamentary agenda.
In March 2020, the prosecutor's office gave a decision of non-prosecution. (EMK/SD)
