Lawyer Yalcindag demanded that those responsible for rights violations and torture are tried and punished at once.
The report was prepared by a research group made up of representatives of IHD, Solidarity Association for the Oppressed (MAZLUM-DER), Confederation of Public Workers' Unions (KESK), and the Turkish Human Rights Foundation (TIHV).
The group sent a copy of the report each to the Human Rights Commission of the Turkish Grand National Assembly (TBMM), President, Prime Minister, Justice and Interior Ministries, the Deputy Prime Ministry for Human Rights, Adana Governor's Office, Adana chief prosecutor's office, and the prosecutor's office at the Adana State Security Court (DGM).
Lawyer Yalcindag said the report could be counted as an application for investigation into the issue. But IHD lawyers have taken on the Perincek case and will file another application to demand that the incident is investigated.
University student Siyar Perincek, son of Mihdi Perincek, who is the IHD representative for eastern and southeastern Anatolia, was killed on May 28, 2004 in front of the IHD building in Adana.
According to witnesses, a gray-colored civilian car went after Perincek and his friend Mehmet Nurettin Basci, who was driving the motorcycle. The car approached the motorcycle and the men in the car opened the car's doors, hitting the motorcycle and causing the two youngsters to fall on the ground.
Witnesses added that Basci got up immediately and ran away. A man, who got out of the car put his gun against Perincek, who was still lying on the ground and fired it.
Perincek was taken to a local hospital 20 minutes after being shot. The hospital did not have an intensive-care unit. He underwent surgery but died two days later. Mehmet Nurettin Bascı was detained and tortured at the Adana police headquarters.
Mehmet Gazi Aydin was also detained and tortured.
Questions to be answered
* Was it a coincidence that Perincek was killed right in front of the Adana IHD branch?
* How possible was it for Perincek to resist the police with a gun after falling on the ground?
* Were the witness testimonies that Perincek was shot as he was lying on the ground by a police officer investigated?
* Although there was an ambulance only five minutes away from the site, why did it take 20 minutes for the ambulance to arrive? Why did the other security officers did not intervene when one of them pressed against on the shoulders of the wounded man with his knees?
* If it is true that victim Siyar Perincek resisted the police with a gun, why isn't the gun or any other explosives seen in photographs taken right after the incident?
* What happened to the clothes?
* Why wasn't Perincek transferred to a hospital with an intensive-care unit after being operated?
* Was the brother of Nurettin Basci detained at 11:30 p.m. on May 28, 2004? Was Nurettin's brother taken to the state hospital pretending he was Nurettin himself? Did he undergo a health check and get a report which said he was healthy?
* Why weren't Basci, Mehmet Veli Karadeniz, Mehmet Kahvecioglu and Mehmet Gazi Aydin, who were all detained, were not allowed to see their lawyers on the second day of their detention? (YS/BB)
