"Abuse is a crime, it cannot be acquitted"

Abused by his father, the child's file has been closed. Father Ş.K. is also a judge. Speaking to bianet, Aynur Erzengin, the mother of the 11-year-old child, says, "I really don't know what to do anymore. How possibly could justice function so poorly? I cannot understand it."
"I will also appeal to the Constitutional Court," adds Erzengin.
Around a month ago, the court gave the parental right to the father, against whom there was an ongoing investigation for abusing his son.
In Adana province, where the father also works as a judge, the court concluded that mother Aynur Erzengin subjected her son to "alienation from his father". The verdict also indicated that what the child said "did not overlap with the natural flow of life" and there was "overload" on the child.
Parental right was given to the father
Aynur Erzengin and Ş.K. got married in 2006. Erzengin divorced him in 2014, indicating that he was using violence on her and her son. The mother had the parental right of her son, who was born in 2010. The child was seeing his father on certain days; after some time, he got more and more irritated. Mother Erzengin took her child to a doctor.
When the child told what happened, it was understood that the father had abused him. Erzengin filed a lawsuit against the father on charge of "sexual abuse". Even though there were six reports confirming the abuse, the father filed a suit for the parental right and won the lawsuit.
According to Erzengin, her ex-husband Ş.K. got married again and he has three other children in this marriage.
'My son's drug dosage increased'
On December 5, 2020, six police officers, a pedagogue and an enforcement officer went to the child's house and tried to take him to his father against his will. Mother Aynur Erzengin says that the child resisted for 4.5 hours and he did not go there thanks to his own efforts:
"The team came home to take him by force. The child tried to jump off the balcony. The pedagogue did not do her job. There is a doctor who has been following my child for 4 years. That doctor increased my son's drug dosage after this incident. He has been using medication for four years.
"After the police came and tried to take him away by force, he got much worse. His tics have increased. He is afraid."
In the video captured by the mother, the child was saying, "I am not going anywhere, please let me alone. I am afraid, you know. He (father) will beat me because I told what he did. I don't want to go."
Dragging the child from his arm, police officers were also heard saying, "Enough now, you are coming with us, we are taking the child."
CHP wanted to meet the mother
Mother Aynur Erzengin says, "Normally, I would like this to be solved quietly, I would like my son's name not to be heard. But it got uglier and uglier in time." She also reiterates that she will make an application to the Constitutional Court regarding the closed file.
The mother adds that the Republican People's Party (CHP) wanted to meet her: "CHP has invited us for a meeting next week. I am planning to go to Ankara next week. I will send my documents beforehand."
Erzengin briefly continues as follows:
"I really do not know what to do anymore. How possibly could justice function so poorly? I cannot understand it. I feel like going in front of the Presidential Complex and crying out loud.
"I have already been there, but I cannot make myself heard. What is more, as this case was closed, I am put in a position of a slanderer.
"And I am constantly paying damages, which are not small amounts: 50 thousand, 45 thousand, 30 thousand lira. 3 thousand lira is cut from my salary every month. They have driven me into a corner and I really do not know what to do. I cry in silence at my workplace."
Working as a physician for 18 years, Aynur Erzengin says that she is constantly subjected to mental examination.
"I cannot find a word to say any longer. I will apply to the Constitutional Court. Normally, if this person was not a judge and did not have friends in high place, one of six medical reports in my hand would suffice for him to be arrested pending trial. But this man has his community behind him." (AÖ/SD)
