Federal Constitutional Court in Germany has rendered a precedent verdict for German jurisdiction.
According to a report by Deutsche Welle Türkçe, the higher court has stopped deportation of a radical Islamist from Turkey due to “the risk that he or she may be tortured and subjected to inhumane detention conditions”.
“Turkey must guarantee that it will comply with the law”
In its decision, the court stated that “torture threat has serious foundation” and added that this situation is not sufficiently checked. The verdict stated that Turkey must guarantee that it will comply with the law in case that person is deported.
Deportation proceedings of the Islamic State of Iraq and Syria (ISIS) supporter figure were halted. Now, German Administrative Court will review the file and declare its decision about the deportation. (PT/TK)
