Doctor doesn’t Examine Trans Woman

Trans woman named H.Ç. who was refused to be examined by gynecologist F.H. for being transsexual has been sentenced to one year and two months of prison.

The court ruled postponement of the sentence.

The doctor said “You are a man” and refused to examine

H.Ç. undergoing gender reassignment surgery last year in a private hospital went to Prof. Dr. Reşat Belger Eye Training Research Hospital, Department of General Surgery in Beyoğlu district to have her prescriptions on March 31, 2014.

According to H.Ç., General Surgery directed her to Gynecology Service. However, the doctor F.H. at the service said, “It is not my area of expertise, I won’t examine you. You are a man, I don’t approve your condition” refusing to examine H.Ç. Thereupon, H.Ç. said he will complain against the doctor who in return said, “Go wherever you want to file the complaint”.

H.Ç. went to head physician with her lawyer to have taken a statement down. The doctor also filed a complaint against H.Ç. over accusation of insult.

H.Ç. accused the doctor of “discrimination, insult, obstructing right to treatment and neglect of medical duty”. After the H.Ç.’s complaint, governorate didn’t let prosecution to be launched.

Objection against governorate’s decision by Social Policies Sexual Identity and Sexual Orientation Association’s (SPoD) attorney Rozerin Seda Kip has been rejected by majority of votes.
