Middle East Technical University (ODTÜ) research member and Eğitim Sen (Education Union) ODTÜ (Middle East Technical University) Workplace Representative, Ekin Erdem Evliya has won the case against the decision to not extend his term of office.
Ankara 11th Administrative Court has ruled that the process to not extend his term of office is contrary to law and annulled the decision.
Annulment from the court
Evliya was working as research member at Civil Engineering Department. Following the promotion talks held in December 2014 he joined the strike action on December 15-16. He was left out of work as his term of office wasn’t extended on December 23, 2014.
Eğitim Sen bringing lawsuit on behalf of Evliya demanded that the proceeding to not extend his term of office be annulled. Eğitim Sen expressed that Evliya is the workplace representative of the union, he was being targeted in the talks concerning promotion payments, and subjected to discrimination because of union activities.
ODTÜ Presidency in its defense stating that Evliya’s union activities and his term of office not be extended are two separate subjects, and Departmental Presidency has negative opinions of him has demanded motion for nonsuit.
The court remarked that while the procedure of not extending the term of office has to be carried out by advise of the head of department, chancellor’s approval upon dean’s negative opinion, it was carried out by head of department which is contrary to law.
The court annulled the decision of not extending the term of office with its ruling dated March 11, 2016. (BK/TK)
