Speaking at the budget discussions at the parliament, Peoples’ Democratic Party (HDP) Adana MP Meral Danış Beştaş has evaluated the Constitutional Court rejecting HDP’s imprisoned Co-Chair Selahattin Demirtaş.
The court Demirtaş’s application yesterday (December 21).
“Constitutional Court is now a part of the executive power”
“The Constitutional Court has once more declared with this decision that it doesn’t represent jurisdiction, it is not independent and impartial and it makes its decision by government’s demands, ideology and politics.
“We state that this decision has nothing to do with justice, fairness, democracy, politics, international values or rule of law.
“The Constitutional Court is now a part of the execution. It is forced to work by executive power’s order and instructions”.
What happened?
Constitutional Court General Assembly decided that HDP Co-Chair Demirtaş’s application concerning the claim that right to elect and be elected is violated is inadmissible on December 21.
The Constitutional Court (AYM) has rejected application of Peoples’ Democratic Party’s (HDP) imprisoned Co-Chair Selahattin Demirtaş.
The AYM previously found HDP Mardin Gülser Yıldırım’s application “inadmissible”.
The court discussed the application that includes claims of violations of “freedom of expression” and “right to elect and be elected”.
The court found the claims groundless and decided that the application is inadmissible.
According to Alican Uludağ from Cumhuriyet, the AYM based its decision on the verdict it rendered on imprisoned HDP Mardin MP Gülser Yıldırım’s application.
“The Constitutional Court doesn’t have a decision [in the past] that the MPs cannot be arrested”.
Demirtaş has been in Edirne Prison since November 4, 2016. Besides, nine HDP MPs including Figen Yüksek who was relieved of HDP and MP duties, and Nursel Aydoğan are behind bars. (AS/TK)
