Bakırköy 4th High Criminal Court in Istanbul opened the case of a U.Ç., a policeman who is accused of sharing insults towards Berkin Elvan via Facebook under the charges of “praising crime and criminals” as well as “abusing his duties”.
Berkin Elvan, a 15 year-old child who has been in comatose for 269 days due to a police gas bomb canister, died on March 11.
Assigned to Karaman province after the incident, U.Ç. was unable to attend the hearing. Berkin Elvan’s mother and father, on the other hand, attended the hearing as complainants.
The hearing was set to March 31, 2015 for the defense of U.Ç. and informing of his attorneys.
However, the case was brought to the attention to the court after a legal struggle where Berkin Family submitted a motion to the court according to Turkish Penal Code Article 215 after prosecutor Ufuk Büyükşengün’s opinion that the case must be dismissed on the grounds that “Berkin Family didn’t apply, the aforementioned crimes didn’t confront two peoples, a culprit couldn’t be mentioned during an investigation and abuse of duty allegations were hoax”.
