Constitutional Court (AYM) President Zühtü Arslan has spoken at the 55th foundation anniversary of the AYM.
At the ceremony, which President Recep Tayyip Erdoğan, Prime Minister Binali Yıldırım, main opposition Republican People’s Party (CHP) Chair Kemal Kılıçdaroğlu, Parliamentary Speaker İsmail Kahraman, and commanders-in-chief of armed forces attended, Arslan said that the AYM doesn’t have the authority to review the statutory decrees (KHK) issued during the State of Emergency (OHAL).
“We cannot be expected to step outside the constitutional borders”
“Purpose of the State of Emergency is to eliminate the threats that cause the State of Emergency and guarantee an environment in which fundamental rights and freedoms are efficiently exercised.
“AYM’s right-oriented approach must be conceived in a way that it protects fundamental rights and freedoms by remaining within the constitutional borders.
“Constitution Article No. 148 explicitly states that the statutory decrees issued during the State of Emergency cannot be taken to the AYM.
“Departing from this point, the AYM ruled that it doesn’t have the authority to review the statutory decrees put into effect during the State of Emergency.
“The AYM cannot be expected to step outside the constitutional borders”. (EKN/TK)
