Acting Chief Prosecutor Hikmen Onen prepared a summary report on Urun's alleged offence against wife Emine Urun and submitted it to the Ministry of Justice for forwarding to the Turkish Grand National Assembly (TBMM).
The report explains that on May 7, 2005, wife Esma Urun filed a complaint to Cankaya District Police Directorate Yildizevler Police Station where she claimed that an argument that broke out between her and husband Halil after she learned of his affair with another woman led to his hitting her on the head with a briefcase and then punching her above the left eye.
The report added that following the incident Esma Urun was examined at the Forensic Medicine Directorate where a report was issued confirming she had sustained light injuries.
Although Esma Urun withdrew her complaint in a May 11 petition, the prosecution maintains that under article 86 of the Turkish Penal Code (TCK), the offence of "deliberate injury" is held outside of the mechanisms of complaint and compromise as a public offence.
According to article 83 of the Turkish constitution, for MP Urun to be investigated, his legal immunity needs to be lifted.
Article 86/2 of the TCK carries a prison term of 4 to 12 months for deliberate injury and foresees an increase of penalty by half if the offence is committed against a close family member. (TK/KO/II/YE)
