The trial over the dismissal of seven workers from the Yurtiçi Kargo courier company has once again ended in favor of the workers.
Hearing three suits for reinstatement filed by seven workers dismissed for joining the All Freight Workers Union (TÜMTİS), the İstanbul 33rd Labor Court first ruled on November 28 that Ekrem Gül and Öner Gül shall be reinstated. As per this ruling, the company will pay the workers damages for unionization in the amount of their annual gross salary and the wages that should have been paid to them for 4 months when they were unemployed.
On November 24, the İstanbul 33rd Labor Court also concluded the lawsuits filed by Emrah Şahin, Adem Gül and Yılmaz Takmaz. Similarly, the court has ruled for reinstatement and the payment of damages for unionization in the amount of their annual gross salary and the wages that should have been paid to them for 4 months when they were unemployed
Hearing the court cases filed by Gürkan Demir and Murat Kızılyıl on November 23, the court has once again handed down the same ruling.
The workers who have been reinstated by the court and will be paid damages were working for a subcontractor. With this court ruling, it has once again been confirmed that the Yurtiçi Kargo courier company employs workers in a sham manner through shell companies.
As of November 29, 2021, 12 court cases against the courier company have been concluded so far and it has been confirmed that the company appeals to fraudulent ways and dismisses workers unfairly and unjustly.
In these cases, the courts ruled for the payment of damages for unionization (to Veysel Dönmez, Serkan Sarıkaya, Celal Şimşek, Yılmaz Takmaz, Emrah Şahin, Adem Gül, Ekrem Gül and Öner Gül and for damages for reinstatement (to Bayram Saçlı, Murat Kızılyıl, Hüseyin Aşkın and Gürkan Demir). (HA/SD)
