Thirty-eight people were filed lawsuits against because of acting as the editor-in-chief of the daily Özgür Gündem for one day. The newspaper published its last issue on August 16, 2016, before being shut down due to a statutory decree.
Ahmet Nesin was acquitted in the trial on July 17 with two other people who joined the campaign.
Nesin has said in a tweet that he has not been given his passport back despite his acquittal.
"I was first arrested, then acquitted for acting as the editor-in-chief for one day at the Özgür Gündem newspaper. Despite that, my passport is still not given. This should be what I said Democratic Fascism. Tomorrow, I will submit a petition for renunciation of citizenship."
Özcan Kılıç, the attorney of Nesin, told bianet that the Ministry of Interior did not give passports to many people, citing Article 22 of the Law on Passports.
Kılıç said that the ministry confiscated passports of not only people who have lawsuits against them but also who are acquitted and even those who do not have lawsuits against them. Nesin is not the only person facing this situation, many dissidents of the government experience such unjust treatment, he added.
Article 22 of the Passport Law"Passports or documents are not issued to the persons who are under general security control, to the persons who are prohibited to leave for foreign countries, to the persons who cannot prove that they have adequate reasons and conditions to submit themselves to the persons whose departure from the country is determined as inconvenient regarding the general security by the Ministry of Interior, to the persons whose relations, coherence or connections to the terrorist organizations were found by the Ministry of Interior, to the persons whose tax responsibilities are informed to the officials having power to issue passports." Trials of Özgür Gündem Editors-in-Chief on WatchThe Editors-in-Chief on Watch campaign of Özgür Gündem daily had begun on May 3, 2016 and ended on August 7, 2016. Daily was closed through the Statutory Decree No. 675 issued under the State of Emergency. Investigations have been launched against 50 of the 56 Editors-in-Chief on Watch who have participated in the campaign. In 11 of these cases, the court has ordered not to prosecute and in 38 cases, a lawsuit has been brought.
