The court has demanded defense from the university which rejected the request for reinstatement submitted by a discharged academic, who previously applied to the university stating that the State of Emergency had been lifted and requesting her reinstatement.
Academic Deniz Kimyon, who was discharged from the Muş Alparslan University as per the Statutory Decree no. 679 on January 6, 2017, applied to the university after the State of Emergency was lifted on July 19, 2018 and demanded that she be reinstated in her previous position.
However, the Presidency of the university rejected the request of Kimyon on the ground that "the State of Emergency Inquiry Commission has been authorized to make a decision regarding her application."
Upon the rejection of the university administration, Kimyon filed a lawsuit, demanding that the rejection of the university be overturned and the execution be suspended.
Court has demanded defense from university
The Van 1st Administrative Court has announced its interlocutory ruling and demanded that the Presidency of the university submit the related documents and its justification of rejection to the court. The court board has also ruled that the request of Kimyon for the suspension of the execution be evaluated after the Presidency has presented its defense.
Speaking to bianet, Deniz Kimyon has stated that she also filed another lawsuit at a different administrative court for the cancellation of her discharge, but the court rejected her application without demanding the defense of either the university or the Council of Higher Education (YÖK) and sent her file directly to the State of Emergency Inquiry Commission.
Emphasizing that the normal procedure has been followed this time, Kimyon has said, "As in the case of rulings given during the State of Emergency, the court could have given verdicts such as 'There is no ground for giving a judgement' or 'the State of Emergency Commission is authorized.' However, it did not give such a verdict and followed the normal legal procedure." (BK/SD)
