The Court of Appeal 7th Civil Chamber has acknowledged leave of employment for familial reasons is a rightful termination for women.
By force of social responsibility that marriage lays on women, the rightful termination rights stated in the law has been granted. The thought that work life cannot be performed as it should be with a marriage, protection of family life and women’s domestic duties urged the lawmaker to make a decision in this direction”.
The Court of Appeal 7th Civil Chamber revoked the ruling of a local court, which refused material compensation demand by a woman who left her job due to “familial reasons”, and ruled that the resignation occurred due to familial reasons and she can receive material compensation, according to a report by state-run Anadolu Agency.
What had happened?
In the incident that took place in Adana, a woman (Y.K.) cancelled her labor contract after seven months on ground of “personal-familial” reasons. She filed a lawsuit as she couldn’t receive material compensation from the workplace.
The defendant employer advocated that Y.K. resigned from her job on her own will, therefore she cannot demand a material compensation. (YY/TK)
