Who Will Be Judging These Murder Cases?

Yaman, Efeoğlu and Gül were disappeared in custody and their investigation files changed the prosecution office for the fifth time. Yaman’s brother says he testified to prosecution offices for 5 times, however he there is no concrete step taken.

"The crime is clear, the person who committed the crime is known; there's the man who confessed that he buried my brother. However they cannot find the 'appropriate legal regulations' for judgment."

Hüsamettin Yaman, Ayhan Efeoğlu and Soner Gül were taken into custody in 1992. They disappeared in custody and their corpses cannot be found. The related investigation file is still in between the prosecution offices.

It's not determined whether there's an organized crime or not so the file changed five prosecution offices on 24th of April and it was sent to specially authorized prosecutor again.

Yaman's brother Feyyaz Yaman was called to give a statement at each prosecution office. Yaman said to bianet that he explained once again how his brother was disappeared to Prosecutor Ayhan Bedirhan from Chief Public Prosecutor of Istanbul, Bureau of Criminal Investigation of Officers.

"There is no concrete step taken"

Yaman says that after their criminal complaint on October 2011, former member of special operations staff Ayhan Çarkın was called to take statements again.

"Çarkın again told that my brother was killed and he buried him. Hereupon they called me to give a statement again. I always go to give statement whenever the prosecution office changes, however there's no concerete step taken, the judgment process does not start."

The investigation about the disappearance in custody began at specially authorized prosecutor and after their "It's not an organized crime" decision, the case file was sent to Şişli Prosecution. Şişli said "It's an organized crime" and sent it back. Specially authorized prosecutor insisted on their decision and sent the case file back to Şişli Prosecution. On 24th of April it was again sent to specially authorized prosecutor.

Feyyaz Yaman is worried because this file might be time-barred after 20 years like some other unsolved investigations.

The investigation was opened after the confessions of Çarkın

Hüsamettin Yaman was a student at Istanbul University, Vocational School of Technical Sciences and he went out in order to find an apartment close to his school on May 4, 1992. One of his friends called his family that evening and told them that Yaman and friend Soner Gül were forced to get into the police car while they were waiting at the bus stop; they were taken into custody. Nothing further was heard from Gül Yaman.

His family got in touch with the State Security Court and Anti-Terror Branch of Gayrettepe however they all said, "He's not here".

When Anti-Terror Branch made the statement to European Court of Human Rights (AİHM) that "We picked up his trail at the organization house. According to the statement of the householder they quit the house and moved to one of the Eastern provinces", the court decided not to prosecute.

Former member of special operations staff Ayhan Çarkın asserted that Efeoğlu, Yaman and Gül were murdered in 1992, he can show the location of their execution and added "I killed Efeğlu. I can show the execution locations of three of them". Thereupon, an investigation was opened and nine more policemen were asked to give statements. (AS)
